This website (https://jobify360.ai, hereinafter: "the Site") was established to offer the public free access to a service for job searching and placement through the analysis of user resumes (as defined below) and matching user information and skills with information about vacancies published on various websites.
The site is operated by TLK SOLUTIONS LTD on behalf of Joint Israel - public benefit corporation (together hereinafter "the Site Operator" or "the Operator").
The Operator offers the information in this online service on the Internet ("the Services") subject to the terms detailed in this policy. The term “User(s)” hereinafter refers to anyone who browses and uses the service offered on the site.
Users of the site are requested to carefully read all the terms detailed in these Terms of Use. Browsing and the use of the site are subject to the terms detailed below, including the privacy policy, and any applicable law, and constitute the user's explicit consent to these terms in full. The Site Operator reserves the right to change the Terms of Use, the privacy policy, and the service offered on the site, to add or remove content, features, and options at its sole and absolute discretion without any need to notify the users. Users hereby waive any right or claim against any of the changes mentioned above or any damage or malfunction that may result from it. It is the responsibility of each user to check and be aware of the Terms of Use and the privacy policy as they may be updated from time to time.
It is forbidden to use the site in a way that may cause damage to the site, the content displayed on it, the networks, or to act in a way that may interfere with or disrupt the site's integrity and availability to other users.
The Service
As part of using the site, the user is asked to upload a resume or manually fill in personal details about their skills, employment history, contact details, etc., to create a unique user profile ("the Profile"). The Operator is entitled to add, delete, and change the profile format from time to time. If the user chooses to upload a resume, the service will automatically create an initial profile that the user can edit. Each user is entitled to create one profile for their personal use only.
After processing the user's data through the service, the site will display a list of jobs published online that match the user's skills and professional experience according to the details entered. Clicking on a job from the list of offered jobs will lead the user to an external site such as AllJobs, Indeed, or LinkedIn. Additionally, the user will receive a recommended list of training courses according to the details entered and clicking on a one of these training courses will also lead the user to an external site. Any action taken on any external site is the sole responsibility of the user and is subject to the terms of the external site.
The services offered through the site do not constitute advice, recommendation, consultation, professional opinion, or a substitute for consulting with an expert in the relevant field.
The Operator has the right, at any time and without the need for prior notice, according to its sole discretion, to prevent certain users from browsing the site, to cancel permissions granted to users, and to deny access to certain content or services displayed on the site. In case of violation of the Terms of Use, the Operator is entitled to deny the user the ability to use the site or parts of it. The site or the content displayed on it must not be used for any purpose other than for the intended use of service or for any illegal purposes whatsoever.
The Service
According to the copyright laws in force in Israel and according to international treaties, the copyright of this service, as well as all other intellectual property rights associated with the service, belong to the Site Operator. These rights apply, among others, to text, names, images, illustrations, maps, sound clips, video clips, trademarks, design, graphics, and software applications ("the Protected Material"), unless explicitly stated otherwise that the rights in the Protected Material belong to another party.
The user is allowed to make "fair use" of the Protected Material, according to applicable law, fair use includes reasonable references of the Protected Material. The reference must cite the source being used from the Protected Material. It is forbidden for the user to forge, damage, or make any other change to the Protected Material, or take any action that will cause the value of the Protected Material to be diminished. Except as explicitly stated in these Terms of Use, the user is forbidden to copy, reproduce, modify, download, upload, redistribute, re-broadcast, or publish Protected Material, or to make any other use without prior and written consent from the Site Operator. It is absolutely forbidden to display the site pages, or parts of them, in interfaces different from those displayed on the site, unless the Operator has approved this, in advance and in writing. The user is not allowed to remove, modify, or conceal any copyright mark, trademark, service mark, or any other marking indicating property rights that are integrated into the site. All trademarks are the trademarks or registered trademarks of their owners. Nothing in these Terms of Use grant the user any right to use a trademark, service mark, trade emblem, or commercial name of the Site Operator or any third party.
Except as explicitly determined herein, the user undertakes not to take and not to allow any third party to take the following actions: (a) reverse engineering, dismantling, or any attempt to discover the source code of the software that underlies the site; (b) modification of the site, manipulation of it, copying, or creating derivative works from it, as well as distribution, renting, broadcasting, public display, publishing, broadcasting, distribution, transfer, or any other use not according to these Terms of Use; (c) operation or enabling of any computer application, robot, spy software, or any other means, including software of the type Crawlers, Robots, and the like, for the purpose of searching, scanning, copying, or automatic retrieval of contents from the site. This includes not creating and not using such means for the purpose of creating a collection, accumulation, or database containing contents from the site or its code; (d) attempt to disable or bypass any security mechanism of the site; (e) attempt to obtain a password or personal details of another registered user or false use of them; (f) impersonation of another user or false representation of the user's identity, including the use of multiple user accounts; (g) infringement of privacy rights and legal rights of third parties including defamation, slander, intimidation, harassment, or stalking of other users; or (h) infringement of copyright, privacy rights, or moral rights of any third party.
By uploading a resume, personal information, pictures, and the like to the site, the user declares that they are the owner of all rights of the information, and they are entitled to upload it to the site and transfer it to any third party, without condition and/or limitation. The user declares that the information uploaded by them is under their exclusive and full responsibility.
The Operator reserves the right to review the contents that will be uploaded or published on the site. It is hereby clarified that the decision whether to review the contents will be made by the Operator, according to its sole and absolute discretion, since there is no obligation on the Operator to review these contents or to check them and since granting or exercising the right to review these contents does not constitute an obligation on the part of the Operator to supervise these contents and/or to impose responsibility on the Operator in relation to those contents. Additionally, the user is aware that the information uploaded to the site will be transferred or may be transferred to the site operator and/or relevant third parties for the purpose of providing the service or as detailed in the Terms of Use, and there is a possibility that such information will also be transferred to potential employers. The user hereby declares and confirms that the uploading of the information, by them, constitutes explicit consent to the transfer of the information and consent to grant the site operator an unlimited license, without consideration, to use the information as detailed in these Terms of Use.
All ideas, requests, feedback, recommendations, error reports and bugs, comments, concepts, additional features and requests, or other suggestions (hereinafter collectively: "Ideas") that a user provides to the Operator will be owned by the Operator. If the user provided the Operator with Ideas as detailed above, the user hereby irrevocably transfers, without any consideration, all intellectual property rights to these Ideas, ,. Additionally, the user agrees that the Ideas will automatically become the property of the Operator and that the Operator will be entitled to use, exploit, implement, adapt, develop, copy, reproduce, publish, license, or dispose of the rights in the materials and Ideas without any obligation to pay the user any royalty or any other payment and without any obligation to mention their name or notify them.
Links to External Sites
The site will display jobs and trainings that are links (hyperlinks) to external internet sites through which it will be possible to submit candidacy for jobs and/or registration for the relevant trainings and which are not part of the site or owned by it such as AllJobs, Indeed, LinkedIn (hereinafter: "the external site(s)").
The user is aware that the Operator does not maintain legal relations with the external sites. The Operator does not control or supervise the information published on external sites. Although there is a referral to them on the site, the Operator does not check and does not supervise the contents of external sites or the reliability of the information displayed on them.
The mere publication of the links to external sites on the site does not constitute consent, explicit or implied, from the Operator to the contents detailed in these sites, and the Operator does not present any representation and does not bear any responsibility for the contents of those sites, the legality of those sites, their reliability, or their currency.
The mere publication of the jobs on the site does not constitute a recommendation, approval, encouragement, or preference from the Operator to engage with the employer who published the job. The Operator reserves the right to change, add, and remove links to the external site, from time to time, and also to refrain from including links to certain external sites, according to its sole and absolute discretion.
Since the information found on external sites is under the exclusive responsibility of the owners of those sites, the Operator strongly recommends that the user examine the Terms of Use of those sites. For the avoidance of doubt, the Operator will not bear responsibility for any loss, damage, or harm, direct or indirect, which may be caused as a result of using the external site, or the information found on them or information drawn from the owners to the site. In any case, reliance on the external sites is under the user's sole responsibility.
Responsibility in Relation to the Site and the Contents Displayed on It
Use of the site is according to the user's sole discretion and under their responsibility. The Operator does not bear responsibility for any content received from third parties, except as explicitly stated in these Terms of Use. The site in its entirety and the contents displayed on the site and the software underlying it and the services offered on the site are provided for use as is (AS-IS) and subject to their availability (AS AVAILABLE). The Operator does not undertake that the contents that will be displayed on the site or the services or products that the user will receive through the site will meet the needs and expectations of the user. The Operator explicitly rejects all responsibility, including, without limitation, explicit or implied responsibility for usability, explicit or implied responsibility for merchantability, suitability for a particular purpose, ownership, or non-infringement. Any reliance on the site or the content is under the user's sole responsibility and the Operator rejects all responsibility, explicit or implied, (a) regarding the accuracy, reliability, timeliness, security, or performance of the site or the content; or (b) that the site and/or the content will be error-free or that the errors, if there are any, will be corrected; or (c) regarding the accuracy, quality, currency, completeness, or usability of any information or content presented on the site. Any advice or information, whether conveyed orally or in writing, that a user will receive from the Operator will not create any responsibility for the Operator, beyond what is explicitly written in these Terms. If a user relies on any such advice and/or information, this reliance is under their sole responsibility.
The content on the site comes from a wide range of sources. The Operator strives that the content will be as accurate as possible, but the Operator does not give any commitment or representation that the site and/or the contents displayed on the site will be useful, reliable, available, accurate, or that they will be free from harmful components such as viruses, Trojan horses, and the like. The Operator does not bear any liability or responsibility in relation to the quality of the contents whose source is from third parties and/or displayed on the site by third parties (including the users) even if the content is offensive, obscene, illegal, infringing copyright, and the like.
The Operator does not bear any liability or responsibility in relation to mistakes, changes, or errors related to the contents displayed on the site. The mere browsing and/or use of the site by the user constitutes their consent to the fact that the user has no right and/or claim towards the Operator regarding the contents displayed on the site and regarding any change or adaptation that will be made in relation to the contents entered into the site.
The Operator makes all efforts so that the site will operate properly and continuously. However, the Operator does not undertake that the site will operate continuously or without faults or without interruptions, that the activity of the site will not be stopped or disturbed, that there will not be mistakes in the contents appearing on the site and that no damages or faults will be caused to users or to the software, hardware, and communication lines that they use.
The user is responsible for taking all necessary measures to prevent the exposure of their personal details (including username and password) to a third party. The Operator will not bear any liability and/or responsibility for any damage, direct or indirect, that may be caused to any of the users as a result of browsing the site and/or using the contents that will be displayed on the site, including any damage that may be caused to the software, hardware, or databases, damage that may be caused as a result of the exposure of the user's details (including information related to the personal settings of the user related to the use of the site), obtaining services or products through the site, relying on the contents displayed on the site or any other damage related to the use of the site, all subject to the liabilities of the Operator according to the Protection of Privacy Law, 1981 and the regulations enacted according to it.
Any use that will be made by the user of any information from the site and/or in the information found in links to external sites is under the user's sole responsibility. Any engagement that will be made following the user's use of the site, will be agreed directly between the interested parties to the engagement, and does not pertain to the Operator or anyone on its behalf.
It is hereby emphasized that despite the fact that the Operator takes accepted measures to secure the site and the contents displayed on the site, the Operator cannot ensure that there will not be intrusions into the site, exposure of information displayed on the site, disruptions or disturbances to the activity of the site. The Operator does not undertake that there will not be unauthorized intrusions into the computers or servers of the Operator and/or the computers of the users. If an intrusion into the site and/or if a third party obtains information displayed on the site, including information belonging to the users or relating to them, and uses it in any way, the Operator will not bear any liability and/or responsibility for this, except according to the Protection of Privacy Law, 1981 and the regulations enacted according to it.
Limitation of Liability and Indemnification
The Operator will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages (including, without limitation, damages for loss of business, loss of reputation, loss of data, loss of profits, or any other intangible loss), under any law including under contract, negligence, strict liability, breach of statutory duty, or otherwise related in any way and in any manner to the service (even if the Operator received notice of the possibility of such damages and even in the absence of remedy in its basic sense). Several jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above may not apply to a specific user. In the jurisdictions mentioned, the liability is limited to the fullest extent allowed by law.
Additionally, the user agrees that the Operator is not and will not be liable for any damage caused to them in connection with the loss of data, errors, system downtime, network or system interruption, communication line failure, file corruption or service disruptions caused due to our negligence or the negligence of our subcontractors and service providers, regardless of the theory on which any claim is based, even if the Operator received notice regarding the possibility of such damages.
Notwithstanding anything to the contrary, the Operator's liability towards the user or any other party for any reason whatsoever and regardless of the manner of operation will be limited at all times to a total of 1 NIS.
The user undertakes to indemnify the Operator and its employees, managers, office holders, contractors, and agents against any claim, demand, compensation, cost, or expense (including attorney fees and legal expenses) arising, directly or indirectly: (a) from breach of these terms by the user or by anyone using their computer or their password; (b) from any claim, loss, or damage arising from their use, attempt to use (or inability to use) the site and/or the content of the site; and (c) from any violation of the law or regulations by the user.
Privacy Policy
The Operator reserves the right to collect various types of information regarding the users on the site, including personal information of the content uploaded to the profile such as: resumes, first and last names, contact details, employment history, education, awards, trainings, volunteering, and any similar information that the user provides through the service (hereinafter: "the Personal Information"). In addition, the Operator may collect information and data on the nature of the use of the service and browsing on the site (for example, other sites that you visited, pages that you viewed) which usually do not cause the identity of the user to be revealed (hereinafter: "Non-Identifiable Information" and together with the Personal Information will be referred to hereinafter: "the Information"). Part or all of the information collected may be transferred to AI engines for the purpose of the system's activity. The process includes extracting information from resumes (such as: education, employment history, etc.) and recommendations for suitable occupations based on the user's skills.
The information collected is intended, among other things, to contact the user, to perform the services as detailed in these Terms of Use, for the purpose of improving the services that the Operator offers on the site and adapting the site to the user's needs and personal preferences, training the system through which the services are provided, as well as, for conducting research, statistical analyses, preventing cyber crimes, frauds, documenting ongoing activity, and managing legal proceedings.
The Operator will be entitled to use the information for the purposes detailed in these Terms of Use and this privacy policy only.
The user hereby gives their consent to the fact that the Operator will be able to collect the information as mentioned, to use the services of third parties and/or to transfer it to third parties mentioned in these terms, provided that the manner of collection, use, and transfer of the information will be carried out according to these Terms of Use and to this privacy policy and subject to the provisions of the law and the provisions of the Protection of Privacy Law, 1981 and the regulations enacted according to it.
Except as explicitly determined in these terms, the Operator will not transfer to any other third party any information that may personally identify the user, unless explicit consent was given for this by the user. Despite the aforementioned, it is hereby clarified, if the Operator becomes required to disclose personal details regarding any of the users by an authorized authority (including a legal or public authority), then the Operator will be entitled to disclose these details even if it involves details relating to the privacy of the user. It is further clarified that the Operator will be entitled to disclose such details, as mentioned above, to the extent that is required for the purpose of maintaining its rights towards the user and/or enforcing the Terms of Use. It is further clarified that if the user will make use of the site in a way that is offensive to a third party and/or infringes upon the rights of a third party and/or the provisions of the law, then the Operator will be entitled to disclose the user's personal details to the extent that this will be required by law enforcement authorities and/or the party claiming to have been harmed by the actions taken by the user. The Operator will cooperate with law enforcement authorities or any judicial order requiring or instructing it to disclose the identity, behavior, or digital content of any user suspected of actions contrary to the law or for any infringement.
Cookies are short text files sent to the user's device through their browser. The Operator uses cookies to personally tailor the user experience and to tailor the advertisements that the user will see on the site. There are several types of similar technologies, such as web beacons, pixel tags, device IDs, and all are included in the definition "cookies". It is possible that third parties, which the Operator relies on in order to provide the services, and/or its business partners, use cookies in the user's browser to collect information in connection with advertisements displayed on third party sites. It is possible that the Operator will use a "persistent cookie" in order to save the settings and personal preferences of the user. For example, if the user logs into the site, the cookie will serve to identify them as a current user, so that they will not need to re-enter their details each time they use the services. Most internet automatically allow the use of cookies but the user can change this setting so that their browser will block certain cookies or so that the browser will notify them each time a cookie is sent. Additionally, the user can delete any existing cookie at any time. It is possible that some of the features of the services will not work properly if the user cancels or removes the cookies.
The cookies used by the Operator may change from time to time. In any case, the types of cookies that are usually used fall into one of the following categories:
- Essential Cookies: These cookies are essential for the proper operation of the services. They help the user access the site, navigate within the site, and use various features, such as remembering past actions in order to return at a later point to previous pages.
- Operational Cookies: These cookies remember your preferences from visit to visit.
- Safety Cookies: These cookies help us identify you and to prevent other users from changing your username and password and other similar actions.
- Analytical Cookies: These cookies help us understand how the users make use of our site. This information helps us improve the site, such as by determining which pages are most popular and which links are not clicked on at all.
- Advertising Cookies: These cookies are intended to deliver advertisements that may be relevant for you. This helps advertisers present new advertisements to you from those you have already seen or to present you with targeted advertisements. Statistical Data and Analytical Tools: The Operator and/or its service providers use analysis tools, which include among others "Google Analytics", MixPanel, and Clarity, in order to collect and analyze information about the use of the site, such as the frequency of visits to the site by users, which pages they visit, and which sites and applications they used before their visit to the site. By analyzing the information that the Operator and/or anyone on its behalf collects, the Operator and/or anyone on its behalf may compile statistical information across a variety of platforms and users, which assists the Operator to improve its site, to understand the trends and needs of the user and to consider new products and services, and to consider the adaptation of existing products and services to the desires of the user. The Operator may share aggregate information that is not linked to personal information with the Operator's partners, without limitation, under commercial terms that the Operator is entitled to determine according to its sole discretion. For the avoidance of doubt, it is clarified that there is no legal obligation on the user to provide the Personal Information in the framework of the use of the service. However, without providing the Personal Information required, it will not be possible to make full use of the service and it will not be possible to receive service from the site.
The Operator may transfer the information to any of its employees, managers, insurers, professional advisors, agents, suppliers, or subcontractors, in a reasonable manner and as required for the purposes specified in this policy. The Operator may transfer the information to any related company, including subsidiary companies in a reasonable manner and as required for the purposes specified in this policy.
The Operator does not collect identifying information from children under the age of 13. In the event that it is proven that a child under the age of 13 registered without the consent of their parents or their guardian, please notify the Operator immediately.
Communication and Messages
The Operator and/or anyone on its behalf may send messages to users about them or about the Operator’s services by various means, including email messages, WhatsApp messages, SMS messages or other forms. For example, the user will be entitled to choose to use a "personal agent" to receive messages about available jobs. Additionally, the Operator and/or anyone on its behalf will be entitled to send surveys, research, and/or questionnaires to the users. By accepting these Terms of Use (or use of the site and/or the services, the user agrees to receive such messages. The user will be able to remove their personal details from the distribution list of the Operator by clicking on an unsubscribe link appearing in every message or by sending an email to the address unsubscribe@jobify360.co.il. User’s should be aware that the Operator reserves the right to send messages related to the site and the services, including administrative messages, referring to their account, without offering the user the option to opt out of receiving such messages, unless the user closes their account.
Additionally, the Operator may transfer the information to a third party according to the following:
1. The Operator is entitled to transfer information to Tevel – the subsidiary company of the Joint, and to partner government offices.
2. The Operator is entitled to disclose non-identifiable information to potential business partners, to investors, or to the public;
3. The Operator is entitled to share information with bodies such as the employment service, related entities, colleges, municipalities, and/or employers with the user's consent.
4. The Operator is entitled to share information with research bodies, including those examining the effectiveness of the services and its system. These bodies will be subject to non-disclosure and non-use obligations.
5. The Operator is entitled to share information with certain third parties that assist with the operation of the site and/or who provide the service (for example, cloud providers, CRM (Customer Relationship Management) providers, supporting ticket providers, and other similar service providers). Such third-party providers will have access to the information required to perform their role, but they will not be entitled to use it for other purposes. All subcontractors will be subject to non-disclosure and non-use obligations.
6. To a qualified authority or another party according to the demand of the qualified authority or by force of law.
7. The Operator may transfer its databases that include the users' information if it sells its activity and/or business or part of it, including during negotiations in connection with such a transaction, including in connection with liquidation and including a transfer outside of Israel.
8. Information that the Operator collects will be stored, processed, and transferred between all the countries in which the Operator and/or its providers operate, such as Israel, the USA, and Thailand. The provider uses cloud services in the USA and by browsing the site or using the service the user expresses their consent to the transfer of their information outside of Israel and processing of the information as described in the policy.
Miscellaneous
Waiver by the Operator of any non-performance will not be considered a waiver of any previous or future non-performance of those provisions or of other provisions in these terms, and a delay or neglect by the Operator in exercising or in using any right or remedy available to it or that will be available to it hereinafter will not serve as a waiver of any right or remedy. If any provision hereinafter will be considered invalid or unenforceable by a court with jurisdiction, the invalidity as mentioned will not affect the validity or enforcement of any other provision and the invalid provision as mentioned will be considered as if it was separated from these terms. The Operator is entitled to freely dispose of its rights and liabilities according to these terms without sending notice to the users. These terms are not transferable or assignable by the users.
These terms constitute a binding agreement between the user and the Operator. The terms constitute the full understandings between the user and the Operator and cancel and replace all previous agreements and are intended to be the final expression of the agreements of the parties. These terms will take priority over any other document that stands in contradiction with them. Any title, note, or section name included in these terms was included for convenience only and in no way defines or explains any section or provision. The Operator reserves the right to change these terms at any time. Any such change will take effect immediately upon its publication. Continued use of the service by the user after the determining date for any such change as mentioned will be considered acceptance of the amended terms as mentioned.
These Terms of Use will be interpreted and governed, for any matter and issue, according to the substantive law of the State of Israel without giving effect to any choice of law principles under which the law applicable to the site, the use of it, the Terms of Use, and any matter regarding the site and the relations between the user and the Operator is the law of the State of Israel. The exclusive and sole jurisdiction for any matter regarding the site, or the use of it, is given to the courts in Tel Aviv-Yafo and the parties explicitly exclude the local jurisdiction of other courts throughout the country.
